Recreational use of cannabis

Since April 2024, adults 18 and older have been allowed to carry up to 25 grams of cannabis in public. At home, you can even possess up to 50 grams of dried cannabis. Cultivating up to three cannabis plants per person at home is also legal. These plants may only be used for personal use and may not be sold.

In addition, so-called Cannabis Social Clubs have been introduced. These clubs offer members the opportunity to cultivate and consume cannabis communally. A maximum of 500 members are permitted per club. Each club requires official approval and is subject to strict controls. The clubs ensure transparency and quality control and offer members safe and regulated access to cannabis.

It's important to note that despite legalization, certain restrictions remain in place. Cannabis consumption remains prohibited near schools, kindergartens, public playgrounds, sports facilities, and in pedestrian zones between 7 a.m. and 8 p.m. Violations may still result in legal consequences.

Furthermore, the sale of cannabis products is only permitted in specially licensed stores. These stores must comply with strict regulations regarding child protection, product safety, and quality controls.

Medical cannabis

Medical cannabis remains legal in Germany. Patients with a doctor's prescription can purchase their cannabis from pharmacies as usual. The cultivation and sale of medical cannabis will continue to be strictly regulated and require official approval.

Legal situation of CBD

CBD products are legal in Germany as long as they do not exceed a THC content of 0.2%. Common CBD products such as oils, capsules, or cosmetics are therefore freely available. However, products containing CBD and sold as food are subject to stricter regulations and require special approval under the EU's Novel Food Regulation.

Challenges and critical voices

Although the new laws are considered progressive, there are also critical voices. Some experts point to potential problems such as an increase in the black market, as the regulated market may not be able to provide sufficient supplies. There are also concerns about the impact on public health and road safety.
